Breeding season begins February l, 2006, and ends June 15, 2006. A copy of the mare's registration papers should accompany this contract. Breeding fee is payable in full upon signing of this contract. ON PREMISES BREEDING: All mares must arrive at KMK Paint Horses, sound to breed, halter broken and with current negative Coggins test. The mare owner agrees to pay all veterinary fees as they occur. A daily board charge of $15.00 wet/ $10.00 dry shall be assessed. SHIPPED COOLED SEMEN: There will be a $250.00 charge for each shipment of semen (payable in advance of shipment) Semen requests must be received no later than 6:00 p.m. (Central Standard Time) the day before regularly scheduled breeding days, which are Monday, Wednesday, and Friday. If you need semen on an off scheduled breeding day, we will attempt to accomodate you but cannot guarantee availability. KMK Paint Horses must be notified by 10.00 a.m. (Central Standard Time) to cancel a shipment or a $150.00 shipping fee will still apply. The mare owner shall assume the risk and expense associated with a lost or delayed shipment and shall hold KMK Paint Horses Horses harmless. GUARANTEES: Live Foal: The stallion owner guarantees a live foal. Live foal is defined as a foal that stands and nurses without assistance. If the mare aborts the foal, the foal dies within 24 hours of birth or the mare dies during pregnancy/birth, the mare owner is entitled to one rebreed. The rebreed is for the same mare or a mutually agreed upon substitute mare to the same stallion and must be used the following year of contract. For any rebreed resulting from a non-viable foal, any applicable mare care, veterinary, and shipping fees will be charged. At the end of that following breeding season, the right to rebreed is cancelled and the stallion owner is released from any further obligation whatsoever. Should the stallion die or otherwise become unfit for service, the stallion owner’s liability shall be discharged fully. Should the stallion be sold, the new owner shall be obligated to honor the terms of this contract. Under Nebraska law, an equine professional is not liable for, injury to, or the death of a participant in equine activities resulting from the inherent, risks of equine activities. The mare owner agrees to look solely to his/her insurance for compensation for any injury, sickness, health or loss of any kind. PAYMENT: Payment past due thirty days will be considered in default and the stallion owner is entitled to exercise all legal remedies available to collect the amount due at the mare owner’s expense. A service charge of 2% Interest will be assessed monthly, until payment is received in full. A breeder’s certificate will be issued upon notification of the birth of the foal, and photographic proof, providing all accounts are current. The mare owner’s signature attests to the fact that the owner has read and understands all of the outlined herein and accepts this contract as a legal and binding instrument in the state of Nebraska.
